TERMS OF SERVICE
to the Public Offer Agreement

1. GENERAL PROVISIONS AND PROHIBITED USE OF SERVICES
- 1.1. All Services provided by the Provider may be used exclusively for lawful purposes and in accordance with the laws of Ukraine, applicable international law, and the rules of relevant Registries, Registrars, infrastructure providers and other authorized organizations.
- 1.2. The Subscriber may not use the Services to host, store, transmit or distribute materials that infringe copyrights, related rights, patents, trademarks or other intellectual property rights of third parties.
- 1.3. The Services may not be used primarily for unlawful file storage or solely as a file or backup repository unless such use is expressly permitted by the applicable tariff.
1.4. The Services may not be used to host or operate:
- 1.4.1. financial pyramids and other fraudulent schemes;
- 1.4.2. resources intended for unauthorized access to information systems;
- 1.4.3. resources facilitating unlawful trafficking in narcotic substances;
- 1.4.4. phishing websites, clones of legitimate websites or other resources intended to steal credentials;
- 1.4.5. malware, botnets, exploit code or other means of conducting cyberattacks;
- 1.4.6. services requiring a special license or permit where the required authorization is absent;
- 1.4.7. unlawful currency or cryptocurrency exchange services;
- 1.4.8. resources whose use threatens the stability of the Provider's network, servers or other information systems;
- 1.4.9. resources subject to substantiated demands of competent authorities or court orders restricting access;
- 1.4.10. any other resources whose use is expressly prohibited by Ukrainian law.
- 1.5. The Provider may temporarily or permanently restrict access to Services if materials or activity indicating fraud, phishing, malware distribution, cybercrime, violence, incitement to hatred, calls for terrorism or other unlawful activity are detected.
- 1.6. The Subscriber is responsible for all actions performed using its account, control panel, servers, websites, mailboxes and other resources.
- 1.7. The Subscriber shall maintain an appropriate level of account security, use strong passwords, keep software up to date and use available multi-factor authentication mechanisms.
- 1.8. If signs of account compromise are detected, the Provider may temporarily restrict access until the causes of the security threat have been eliminated.
2. SPAM PROHIBITION
- 2.1. The Services may not be used for mass distribution of unsolicited electronic messages (SPAM), including advertising messages sent without the required consent of recipients.
- 2.2. The Provider's infrastructure may not be used for mailings that result in the Provider's IP addresses or related network resources being listed in generally recognized blocklists.
- 2.3. If spam activity is detected, the Provider may temporarily block the relevant account, mailbox, IP address or other resource without prior notice.
3. VIRUSES AND MALICIOUS SOFTWARE
- 3.1. If viruses, shell scripts, backdoors, malware, botnet clients or other malicious software are detected on the Subscriber's resources, the Provider may notify the Subscriber that the threat must be eliminated.
- 3.2. The Subscriber shall take measures to remove malicious software and eliminate vulnerabilities that caused its presence.
- 3.3. Failure to respond to the Provider's notice or failure to properly eliminate the threat may constitute grounds for temporary restriction or termination of the relevant Service.
- 3.4. If malicious activity creates an immediate threat to the Provider's infrastructure or third parties, access may be restricted without prior notice.
4. VIRTUAL HOSTING RESOURCE USAGE
4.1. The Subscriber shall use resources included in the tariff in a manner that does not interfere with normal operation for other users.
4.2. For Virtual Hosting Services, the following is not permitted:
- 4.2.1. sustained use of more than 25% of available system resources for more than 90 seconds;
- 4.2.2. use of more than 100 CPU minutes per day;
- 4.2.3. running search indexers, except indexers used exclusively for the Subscriber's own websites;
- 4.2.4. executing SQL queries that run continuously for more than 15 seconds;
- 4.2.5. creating MySQL databases containing more than 1,000 tables;
- 4.2.6. using databases to store files and images instead of storing them in the file system;
- 4.2.7. storing email in excess of the disk space allocated under the applicable tariff;
- 4.2.8. creating backup archives larger than 3 GB unless otherwise provided by the tariff.
- 4.3. The total size of the Subscriber's databases may not exceed 30% of the disk space of the relevant tariff unless otherwise provided by the tariff.
- 4.4. The daily volume of database write operations may not exceed 500 MB unless otherwise provided by the tariff.
- 4.5. In case of systematic exceeding of the specified limits, the Provider may offer the Subscriber a tariff with greater resources or another type of Service.
5. RESOURCE USAGE LIMITATIONS
- 5.1. The designation of a resource as “unlimited” means that no fixed quota is specified in the tariff; it does not mean that the physical or technical capacity of the infrastructure is unlimited.
- 5.2. Server, storage, CPU, RAM, network equipment and connectivity resources are shared or technically limited resources.
- 5.3. If the Subscriber's resource consumption substantially exceeds the load normally associated with the relevant tariff and negatively affects other users or infrastructure stability, the Provider may require the Subscriber to reduce the load.
- 5.4. The Subscriber may be given up to 48 hours to eliminate excessive load.
- 5.5. If the requirement is not fulfilled or excessive resource usage is systematic, the Provider may restrict the relevant resource, suspend the Service or offer migration to another tariff.
6. COPYRIGHT AND OTHER RIGHTS INFRINGEMENT
- 6.1. If the Provider receives a substantiated complaint from a third party concerning infringement of copyright, related rights or other intellectual property rights, the Provider may send the Subscriber a corresponding notice.
- 6.2. The Subscriber may submit objections and documents confirming the lawful use of the relevant information.
- 6.3. If the Subscriber has lawful rights to use disputed content, it may provide supporting documents or explanations.
- 6.4. If an infringement is confirmed or the Subscriber fails to provide substantiated objections within the applicable period, the Provider may restrict access to the relevant electronic information.
- 6.5. Where Ukrainian law provides for a special procedure for notices concerning cessation of infringement, the Provider shall follow that procedure.
- 6.6. For cases governed by Article 52-1 of the Law of Ukraine “On Copyright and Related Rights”, the deadlines and procedures established by that Law shall apply.
7. SSL/TLS CERTIFICATES
- 7.1. The Provider provides Services for arranging orders, issuance, renewal, reissuance, replacement and technical support of SSL/TLS Certificates.
- 7.2. SSL/TLS Certificates are supplied under the WHITESSL brand and issued by the relevant Certification Authorities (CAs).
- 7.3. The Provider may act as a supplier, reseller, partner or technical intermediary of the relevant Certification Authority.
- 7.4. The final decision regarding Certificate issuance, domain validation, organization validation, verification of contact details, renewal, reissuance, suspension or revocation is made by the relevant Certification Authority in accordance with its rules and policies.
- 7.5. To obtain an SSL/TLS Certificate, the Subscriber shall provide accurate information and documents required for the relevant validation type.
- 7.6. For DV Certificates, the Subscriber shall demonstrate control over the relevant Domain Name using one of the methods specified by the Certification Authority.
- 7.7. OV and EV Certificates may require additional verification of the legal entity, its address, telephone number, right to use the Domain Name and other information.
- 7.8. The time required to issue an SSL/TLS Certificate depends on its type, validation results, timely provision of required documents by the Subscriber and actions of the relevant Certification Authority.
- 7.9. The Provider does not guarantee issuance of an SSL/TLS Certificate where the Subscriber has failed validation or does not meet the requirements of the relevant Certification Authority.
- 7.10. The Provider may request additional documents or information required for the validation procedure.
- 7.11. After successful issuance, the Certificate and necessary materials shall be delivered to the Subscriber electronically.
- 7.12. Unless expressly provided by the tariff, installation of an SSL/TLS Certificate on the Subscriber's server is not included in the Certificate issuance fee.
- 7.13. The Subscriber is responsible for correct installation of the Certificate and web-server configuration unless a separate installation Service has been ordered.
- 7.14. The Private Key generated for an SSL/TLS Certificate is confidential information of the Subscriber. The Subscriber shall store it securely and prevent disclosure to third parties.
- 7.15. The Provider shall not be liable for compromise of the Private Key if such compromise occurred through the fault of the Subscriber, its employees, contractors or third parties who obtained access to the Subscriber's servers.
- 7.16. If compromise of the Private Key is suspected, the Subscriber shall immediately notify the Provider and take measures to revoke and reissue the Certificate.
- 7.17. Reissuance, replacement and revocation of SSL/TLS Certificates are performed in accordance with the rules of the relevant Certification Authority.
- 7.18. If a Certificate has already been issued by the Certification Authority, the amount paid for its issuance is non-refundable except where expressly provided by law, the terms of the relevant product or the Certification Authority's policy.
- 7.19. If a Certificate cannot be issued because the Subscriber does not meet validation requirements, provides inaccurate information or documents, or fails to take required actions, this shall not constitute improper provision of the Service by the Provider.
- 7.20. If the Certification Authority changes the rules for issuance, validation, validity periods or availability of particular SSL/TLS Certificate types, the Provider may offer the Subscriber an alternative Certificate.
- 7.21. Automatic renewal of an SSL/TLS Certificate is possible only where the relevant technical functionality is available and provided that payment is made on time and the required validation procedure is completed.
- 7.22. The Subscriber consents to the transfer to the Certification Authority of information and documents required for issuance, renewal, reissuance or verification of the SSL/TLS Certificate.
- 7.23. Separate rules and policies of the Certification Authority may apply to SSL/TLS Certificates and shall be mandatory for the relevant product.
8. SECURITY AND CYBER THREATS
- 8.1. The Services may not be used for DDoS/DoS attacks, network scanning, unauthorized access, malware distribution, phishing, botnet activity or other actions aimed at disrupting information systems.
- 8.2. If activity creating a threat to the information security of the Provider or third parties is detected, the Provider may immediately apply technical protection measures.
- 8.3. Such measures may include blocking an IP address, port, Domain Name, website, mail service or other resource.
- 8.4. The Provider may cooperate with CERT-UA, law enforcement authorities, domain zone administrators, Registrars, network operators and other authorized organizations on cybersecurity matters.
9. FINAL PROVISIONS
- 9.1. These Terms constitute an integral part of the Public Offer Agreement.
- 9.2. In case of conflict between these Terms and mandatory provisions of law, the provisions of law shall prevail.
- 9.3. Domain Names are additionally subject to the rules of the relevant Registry and Registrar.
- 9.4. SSL/TLS Certificates are additionally subject to the rules and policies of the relevant Certification Authority.
- 9.5. The Provider may amend these Terms by publishing a new version on its official website.
